IN THE HIGH COURT OF KERALA AT ERNAKULAM
P.V.KUNHIKRISHNAN, J

For the Appellants/Petitioners: SHRI.ZAKEER HUSSAIN, SMT.K.A.SANJEETHA, SHRI.ABY GEORGE, SHRI.MUNEER P.M.
For the Respondents: SRI C N PRABHAKARAN, SC, SRI P SANJAY, GP, SMT DEEPA V

The Court allowed a review petition based on the lack of entitlement of a writ petitioner to renew a trade license previously held by another.

Headnote:The Review Petition was filed to reconsider the interim order regarding the renewal of a trade license. The petitioner claimed the prior license belonged to someone else, creating no grounds for renewal. The Court allowed the petition, recalling its interim order, indicating merit in the review petitioners' arguments. Consequently, the interim order dated 26.11.2025 is recalled.

ORDER

This Review Petition is filed to review the interim order dated

26.11.2025 in I.A No.3 of 2025 in WP(C) No.35557 of 2025. The order passed by this Court is extracted hereunder:

" After hearing both sides I am of the considered opinion that, the petitioner's application for renewal of trade lincese is to be considered by the Corporation.

Therefore, there will be a direction to the 1st respondent to consider the renewal of trade license without insisting on the production of landlord's affidavit, aadhar card or any other documents relating to the landlord, subject to the result of this writ petition."

2. The contention of the review petitioners is that the writ petitioner has no right to file a renewal application, and the license was in the name of one Rufas Ahamed. It is also the case of the review petitioners that Rufas Ahamed had already requested the Corporation to cancel the license, and the license was accordingly cancelled as per Ext.R4(a). It is also submitted by the petitioners that in such circumstances, there is no question of considering a renewal application. I think there is force in the argument of the review petitioners. The writ petition can be considered in detail.

The interim order passed by this court can be recalled.

Therefore, this Review Petition is allowed. The interim order dated 26.11.2025 in I.A No.3 of 2025 in WP(C) No.35557 of 2025 is recalled. The contentions of the writ petitioner can be decided in the writ petition.
