The writ petition was filed seeking to direct the respondents to modify Ext.P3 Recruitment Rules and to delete the five year experience clause imposed on regular feeder cadre employees thereby ensuring level playing filed between all channels of promotion to the post of Junior Manager (General/Marketing).

The writ petition was disposed of holding that the post of Junior Manager (General) is being a post of managerial nature and as the internal candidates are to be promoted to the post without subjecting them to any competitive examination, the Rule making authority felt that they should have at least a minimum practical experience in the Supplyco before being considered for promotion. This Court did not find any illegality in the prescription of experience for the Senior Assistant (Grade-I) for promotion to the post of Junior Manager (General).
3. The petitioner has come up with this review petition alleging errors apparent on the face of the records of the case. The petitioner would submit that the judgment did not address the petitioner's crucial contention that any reliance on 1997 Government Order mandating compulsory deputation is legally untenable. The review petitioner also alleges unjust relaxation to the deputationists and relying on the doctrine of legitimate expectation.
After hearing the parties, I find that this Court has upheld the five year experience prescribed, giving cogent reasons. The petitioner has not put forth anything to unsettle the findings. The review petition is without any merit and it is hence dismissed.
