J U D G M E N T

This appeal has been filed by the claimant in OP(MV)

No.1574 of 2011 on the files of the Motor Accidents Claims Tribunal, Ernakulam, claiming enhancement of compensation. The respondents herein were the respondents 1-3 before the tribunal.

2. The case of the claimant was that on 12.07.2011 at

9.30pm, while he was pillion riding on a motorcycle bearing Reg.No.KL-43/B-3994 ridden by the 2nd respondent in a rash and negligent manner, when reached at Panayappilly North Bhagom, hit on an another motorcycle bearing Reg.No.KL-43/768 ridden by the additional 5th respondent. As a result of which, the claimant fell down and sustained serious injuries. The claimant approached the tribunal claiming a total compensation of ₹10,00,000/-.

3. Respondents 1, 2 and 3 were the owner, rider and the insurer of the offending motorcycle bearing Reg.No.KL-43/B-3994 respectively. The additional respondents 4, 5 and 6 were the owner, rider and insurer of the other motorcycle bearing Reg.No.KL-43/768. The respondents 1, 2 and 4 remained absent and were set ex parte before the tribunal. The additional respondents 5 & 6 did not file any written statement before the tribunal. The third respondent in
