Headnote:The writ petition seeks directions for updating the Standard Operating Procedures in the vehicle transfer process to facilitate access for authorized dealers under relevant motor vehicle rules. The second respondent confirmed that technical issues with the VAHAN portal have been addressed, allowing OTP delivery to dealers' mobile numbers. Consequently, the writ petition is considered closed. Final outcome: the same is closed.

JUDGMENT

The writ petition is filed with the following prayers:

“i. Issue a writ in the nature of mandamus or such other writ order or direction commanding the respondents to consider Exhibit P5& P6 representations and update the Standard Operating Procedures (SOP) in relation to transfer of ownership of the vehicle in the vahan.parivahan portal in the light of Exhibit P2 rules and Exhibit P3 circular by facilitating an authorized dealer of registered vehicles under Rule 55A of the Central Motor Vehicle Rules , 1989 to access the ‘application submission page’ by generating OTP in the mobile number of the authorized dealer of registered vehicles. ii. Issue a writ in the nature of mandamus or such other writ order or direction commanding the respondents to update the Standard Operating Procedures (SOP) in relation to transfer of ownership of the vehicle in the vahan.parivahan portal by facilitating the registration of the mobile number of the authorized dealer of registered vehicles under Rule 55A of the Central Motor Vehicle Rules , 1989 so as to enable access the ‘application submission page’.

iii. Dispense with the English translation of the vernacular exhibits until such time as otherwise ordered by this honorable court.

iv. Issue such other writ order or direction as this Honorable Court may deem fit and apposite in the facts and circumstances of the case.”

2. A statement has been filed on behalf of the 2nd respondent on

15.01.2026, which reads as follows:

8. It is submitted that the issue was taken up and brought to the notice of software developer National Informatics Centre, New Delhi, for necessary modification in the VAHAN system and the technical issue has been resolved by NIC. At present, the OTP required for submission of applications for transfer of ownership and other permitted services is successfully delivered to the mobile number of the authorized dealer (dealer licence holder) enabling smooth processing of transactions in vehicles held under Form 29C.

9. When a vehicle is handed over to a dealer through Form 29-C, the dealer’s mobile number is automatically captured in the DAUC portal. For any subsequent services related to this vehicle in VAHAN, the OTP is sent to the dealer’s registered mobile number. Likewise, when the vehicle owner takes back the vehicle from the dealer upon submission of Form 29-D, the dealer’s mobile number captured in the DAUC portal is automatically removed by the system software.”

3. The above statements are recorded. In view of the above, nothing further remains to be considered in this writ petition and the same is closed.
