JUDGMENT
This appeal is filed by the claimant in O.P (MV) No.157 of 2013 on the file of the Motor Accidents Claims Tribunal, N.Paravur, dissatisfied with the quantum of compensation awarded by the tribunal. The respondent herein is the 2nd respondent before the tribunal.
2. The case of the claimant is that on 20.11.2012 at about 8.30 a.m, while the claimant was riding a motorcycle bearing Reg. No.KL-7/Z 4200, another motorcycle bearing Reg. No.KL-42/E 2337 ridden by the first respondent in a rash and negligent manner, collided with the motorcycle ridden by the claimant. As a result of which, he sustained grievous injuries. The claimant approached the tribunal claiming a total compensation of ₹4,70,000/- limited to ₹3,00,000/-.
3. The first respondent/ owner cum driver offending vehicle was set as ex parte before the Tribunal. The second respondent- insurer filed a written statement admitting the insurance policy but disputing the quantum of compensation claimed. Before the tribunal, PW1 was examined and Exts.A1 to A10 were marked.
