Disputes under Kerala Co-operative Societies Act must be resolved through proper administrative channels as prescribed therein.

Headnote:This judgment pertains to proceedings under Section 69 of the Kerala Co-operative Societies Act, 1969, clarifying that disputes must be adjudicated there. The court upheld that pending applications should be entertained within a month of receiving the judgment copy. The petitioners were allowed to pursue their claims accordingly.

JUDGMENT

In the light of the issues raised herein, this writ petition will also stand disposed of in the light of the declaration of law by this court in the judgment dated 16.01.2026 in W.P.(C)No.33272/2025. Any dispute between the petitioners and the Society/Bank in this case will be adjudicated at the instance of the petitioners in proceedings under Section 69 of the Kerala Co-operative Societies Act , 1969 (hereinafter referred to as the ‘1969 Act’). Since this writ petition was pending before this court, the petitioners shall be permitted to file a suitable application under of the 1969 Act before the competent authority within a period of one month from the date of receipt of a certified copy of this judgment.

The writ petition is ordered accordingly.
