2026 Supreme(Online)(Ker) 5034

IN THE HIGH COURT OF KERALA AT ERNAKULAM
MOHAMMED NIAS C.P., J
EDWARD – Appellant
Versus
STATE OF KERALA – Respondent
WP(C) NO. 1966 OF 2026

Advocates:
For the Appellants/Petitioners: SRI.LATHEESH SEBASTIAN

The court ruled that an NOC from the Revenue Department is not a prerequisite for processing applications for electricity connections.

Headnote:The petitioner challenged Ext.P3 order, where the Electricity Board rejected an application for a fresh connection due to a lack of NOC from the Revenue Department. The Court, referencing similar judgments (Exts.P4, P5), directed that the application be considered without the NOC requirement. The ruling emphasized it would not hinder subsequent actions by the Revenue Department against the petitioner.

Result: The sixth respondent is directed to act on the application without insisting on NOC.

JUDGMENT

The petitioner challenges Ext.P3 order, through which an application for a fresh electricity connection was rejected by the Electricity Board for want of an NOC from the Revenue Department.

2. In similar situations, this court had passed judgments, including Exts.P4 and P5, directing the Electricity Board to consider the application on merits without insisting on NOC.

Accordingly, the writ petition is disposed of directing the sixth respondent to pass orders on the application seeking a fresh electricity connection, if the application is otherwise in order, without insisting on the NOC from the Revenue Department. However, it is made clear that this judgment will not prevent the Revenue Department from taking appropriate steps against the petitioner, if warranted.
