IN THE HIGH COURT OF KERALA AT ERNAKULAM
MOHAMMED NIAS C.P., J
EDWARD – Appellant
Versus
STATE OF KERALA – Respondent

Advocates:
For the Appellants/Petitioners: SRI.LATHEESH SEBASTIAN

JUDGMENT

The petitioner challenges Ext.P3 order, through which an application for a fresh electricity connection was rejected by the Electricity Board for want of an NOC from the Revenue Department.

2. In similar situations, this court had passed judgments, including Exts.P4 and P5, directing the Electricity Board to consider the application on merits without insisting on NOC.

Accordingly, the writ petition is disposed of directing the sixth respondent to pass orders on the application seeking a fresh electricity connection, if the application is otherwise in order, without insisting on the NOC from the Revenue Department. However, it is made clear that this judgment will not prevent the Revenue Department from taking appropriate steps against the petitioner, if warranted.
