This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short, BNSS ), seeking pre-

arrest bail.

2. The applicant is the accused No.2 in Crime No.1498/2025 of Cherthala Police Station, Alappuzha District. The offences alleged are punishable under Sections 296 (b), 115(2), 126(2), 118(1) and 324(4) r/w Section 3 (5) of the BNS, 2023.

3. The prosecution case, in short, is that while the defacto complainant and his friends were travelling on their motorcycles, one of their motorcycles allegedly met with an accident involving another motorcycle near Kadampanakulangara Temple. On 27.10.2025 at 10:30 a.m., the applicant, who witnessed the accident, questioned the defacto complainant about the incident, which led to a quarrel between them. Due to this animosity, applicant, with common intention, wrongfully restrained the defacto complainant and his friend, one Sri.Vishnu, and abused them using filthy language. The accused No.1 fisted on the chest of the defacto complainant and left ear.
