The dismissal of a petition as infructuous occurs when the requested action has been completed.

Headnote:The petitioner, 2nd accused in Crime No.674 of 2018, sought a directive for investigation completion. The Public Prosecutor indicated that the investigation was finalized and a report is filed. Consequently, as the petition became infructuous, the Court dismissed it. The final verdict clearly stated, 'it is dismissed as infructuous'.

J U D G M E N T

(Dated this the 29th day of January, 2026)

The petitioner who is the 2nd accused in Crime No.674 of 2018 of Karukachal Police Station, filed this W.P.(Crl.) with a prayer for giving a direction to the respondent to complete the investigation as against him and file the final report.

2. The learned Public Prosecutor, upon instructions, submitted that the investigation with respect to the petitioner was already completed and final report was also filed. From the report filed by the Special Judge, Fast Track Special Court, Changanassery, it is also revealed that a split charge against the petitioner was filed before the Additional District and Sessions Court (PoCSO) on 24.11.2021.

In the above circumstance, this W.P.(Crl.) became infructuous and accordingly, it is dismissed as infructuous.
