Learned Counsel for the petitioner submits that in view of the material defects that have occurred in the Crl.M.C, he may be permitted to withdraw the Crl.M.C, without prejudice to the right to file a fresh Crl.M.C on the same cause of action.

Recording the above submission, the petitioner is granted liberty to file a fresh Crl.M.C on the same cause of action. Consequently, the Crl.M.C is dismissed as withdrawn.
