The Municipality contends all contract payments are settled, but additional payments for certain works, assured by the Chairperson, remain. The Court orders the Municipality to decide on the petitioner's pending representation Ext.P3, ensuring he is heard, within one month. JUDGMENT

The petitioner is an electrical contractor and this writ petition is submitted by the petitioner to direct the 1st respondent Municipality to release an amount of Rs.13,47,429/-, which, according to the petitioner, is due to him in respect of certain supplies made towards the annual maintenance of street light and high Mast light within the Municipality. A statement has been submitted by the respondents, pointing out that all the amounts as per the contract are released to the petitioner and no further amounts are due. However, it is the submission of the learned counsel for the petitioner that, the petitioner had made certain additional supplies based on the assurance of the Chairperson of the Municipality and what remains to be paid is in respect of that additional works. Any how, it is seen from the records that, the petitioner submitted Ext.P3 representation before the 2nd respondent, which is now pending consideration.

In such circumstances, this writ petition is disposed of directing the respondents to take a decision on Ext.P3 after giving the petitioner an opportunity for being heard. Orders in this regard shall be passed within a period of one month from the date of receipt of a copy of this judgment.
