The original petition was filed seeking to challenge this order, and since the case originated in 2016, the court directed the Munsiff Court to expedite the resolution of the suit. The court stated 'the only direction that can be granted is to expedite the suit'. The court found no reason to interfere with the prior ruling.

JUDGMENT

The original petition has been filed challenging the order in CMA.No.4 of 2019 passed by the Sub Court, Payyannur, whereby an order of injunction against interference with user of a way granted by the trial court was confirmed. The order was issued on 27.06.2023. The original petition was moved on 11.07.2024 and this Court was not inclined to admit or grant an interim order. The case was subsequently moved only in January, 2026. I do not find any reason to interfere with the order of the trial court at this stage. Since the suit is of 2016, the only direction that can be granted is to expedite the suit.

In the above circumstances, this original petition is disposed of directing the Munsiff Court, Payyannur to consider and disposed of OS.No.85 of 2016, at the earliest, at any rate, within six months from the date of receipt of a copy of this judgment.
