JUDGMENT

It is submitted by the learned counsel on both sides that the matter has been settled between the parties by recourse to Section 89 of the Code of Civil Procedure , 1908 (for short, ‘CPC’), on a reference made by this Court on 05.01.2026.

2. The Mediator has submitted a memorandum of agreement along with the report. This appeal is disposed of in the light of the said agreement. The memorandum of agreement shall form part of the judgment.

Since the matter has been settled between the parties by recourse to Section 89 of the CPC, the appellant will be entitled for refund of court fee on usual terms. All pending interlocutory applications will stand closed.
