ORDER
This application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, BNSS ), seeking regular bail.
2. The applicant is the accused No.1 in Crime No.12/2026 of Koyilandy Police Station, Kozhikode District. The offences alleged are punishable under Section s 126 (2), 118(1) and 110 read with Section 3 (5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘ BNS ’).
3. The prosecution case, in short, is that at 12.30 a.m. on 02.01.2026, accused Nos.1 to 4, in furtherance of their common intention, wrongfully restrained the first informant at Koyilandy harbour, and the applicant stabbed the first informant on the back with a broken piece of glass. When the applicant attempted to stab him again, the first informant evaded the attempt; had he not so evaded, it would have caused his death. Thus, the accused are alleged to have committed the aforementioned offences.
