This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short, BNSS ), seeking pre-arrest bail.
2. The applicant is the accused No.4 in Crime No.708/2025 of Kasaba Police Station, Palakkad District. The offences alleged are punishable under Section s 316 (2), 318(4), 351(2) read with Section 3 (5) of the Bharatiya Nyaya Sanhita , 2023 (for short, BNS ).
3. The prosecution case, in short, is that during the period from 04.12.2022 to 18.06.2025, the applicant, along with three other accused persons, induced the defacto complainant to believe that she would receive 9% return by investing money in cryptocurrency trading, and thereby committed cheating and criminal breach of trust, causing a total loss of Rs.1,02,74,200/-. It is further alleged that when the defacto complainant demanded the return of her money and gold ornaments, the accused threatened her, stating that she would not recover her assets and that she and her family would be falsely implicated in a criminal case.
