JUDGMENT

The above Writ Petition (C) is filed with the following prayers:

"i) Call for the records pertaining to Ext P 5 application submitted by the petitioner.

ii) Issue a writ of mandamus, any other writ, appropriate order directing the 2nd Respondent to call for report from the 6th Respondent within a time frame.

iii) Issue a writ of mandamus, any other writ, appropriate order directing the 6th Respondent to file report and complete the proceedings in connection with Exhibit P5 within a time frame.

iv) Issue a writ of mandamus, any other writ, appropriate order directing the 2nd Respondent/Authorized Officer to consider and pass orders in Exhibit P5 application (Form 9) after obtaining all necessary inputs within a time frame.

v) This Honourable Court may be pleased to dispense with the translation of the vernacular documents produced in the vernacular language vi) Provide cost of the proceedings. ."

2. When this Writ Petition came up for consideration before this Court on 14.08.2025, this Court passed the following order:

“The learned Senior Government Pleader submits that, the petitioner's form 9 application has been returned to him for the purpose of submitting the sketch.

In light of the above submission, it would be up to the petitioner to resubmit the form 9 Application and then, moved this writ petition.”

3. Thereafter, on 23.10.2025, this Court passed the following order:

“The Government Pleader will verify whether Form - 9 along with the sketch is received by the authority concerned. Post on 07-11-2025.”

Again on 07.11.2025 this Court passed the following order.

“The Government Pleader submitted that the required sketch is not received. Petitioner will do the needful.”

Today, when the matter came up for consideration, the learned counsel appearing for the petitioner submitted that sketch is already produced and it is uploaded in the official portal also.

If that is the case, there can be a direction to consider Form 9 application. Therefore, this writ petition is disposed of with the following directions:

1. The 6th respondent is directed to submit the necessary report based on the Ext. P5 application to the 2nd respondent/Authorised Officer, as expeditiously as possible, at any rate, within a period of one month from the date of receipt of a certified copy of this judgment.

2. The 2nd respondent/Authorised O directed to consider Ext. P5 application (if it is pending and if it is in order) based on the report received from the 6th respondent, as expeditiously as possible, at any rate, within a period of twomonths from the date of receipt of the report.

3. The petitioner will produce a certified copy of this judgment, along with a copy of this Writ Petition with exhibits, before the 2nd and 6th respondents for compliance.
