JUDGMENT

The prayer in this original petition is to set aside Ext.P14 and to direct the court below to allow I.A.No.4 of 2025. The prayer in I.A.No.4 of 2025 is to remit the Commission report. In Ext.P14 the court has found that there is no necessity for remitting the report. The suit is of the year 1996 and going through the records, there are already several Commission reports. No purpose will be served by retaining this original petition by this Court. It is for the trial court to decide whether there is a requirement for a Commission report in order to properly dispose of the suit.

In the above circumstances, I do not find anything wrong in the order which has now been issued. This original petition is disposed of, directing the court below to proceed with the suit and if at a later stage it is found necessary that an additional report is to be called for, it is open to the court to pass necessary orders in that regard.
