IN THE HIGH COURT OF KERALA AT ERNAKULAM
BASANT BALAJI, J
ARUN P J. – Appellant
Versus
THE MERCANTILE BANK LTD. – Respondent
JUDGMENT
The petitioner availed a housing loan and another loan from the
1st respondent Bank. For securing the aforesaid loans, the petitioner had furnished collateral security in the form of property measuring 73.50 cents, together with a residential building and all improvements thereon, comprised in Re-Sy. No. 743/03 of Kulanada Village. Unfortunately, the petitioner met with a road accident and sustained serious injuries, which prevented timely remittance of the loan instalments. Despite requesting the respondent Bank to restructure or regularise the loan, no relief was granted. On account of default in repayment, the respondent Bank initiated recovery proceedings. Aggrieved by the same, the petitioner approached this Court seeking appropriate reliefs.
2. When the matter was taken up for consideration today, the learned counsel for the petitioner submitted that the entire amount due to the Bank has been remitted and, consequently, the loan account stands closed.
In view of the above, there is no further dispute requiring adjudication, and accordingly, this writ petition is closed.
