Court emphasizes the importance of timely trial proceedings in bail applications, permitting reapplication if delays occur.

Headnote:The applicant sought bail under the premise of undue delay in trial, referencing the ongoing case in S.C. No.151/2024. The Special Court reported that trial proceedings are complete and next steps are scheduled, leading the court to dismiss the bail application but allowing for future requests should delays persist.

Result: Bail application is dismissed but applicant may reapply if trial prolongs further.

ORDER

The applicant, who is the accused in S.C. No.151/2024 on the files of the Fast Track Special Court, Kattappana (for short, ‘the Special Court’), sought regular bail on the ground that the trial is unduly delayed. Hence, I called for a report from the Special Court as to the present stage of the case. The learned Special Judge has reported that the trial is over and the case stands posted to 04.02.2026 for questioning the accused under Section 313 (1)(b) of Cr.P.C. It is also reported that the case could be disposed of within a period of one month.

Hence, this bail application is dismissed. However, if the trial is further prolonged, the applicant is free to move for regular bail again.
