Heard Smt.Jensiya, the learned counsel for the petitioner and Sri.Sunil Nath, learned Government Pleader.

2. The issue raised in this writ petition is already decided in favour of the petitioner by a Division Bench of this Court in Ext.P11 judgment dated 13.12.2021. It is further pointed out that an appeal preferred by the State against the afore judgment is also rejected by the Apex Court by an order dated 28.02.2023 in S.L.P.(C)

No.4420/2023.

In the light of the afore, this writ petition would stand allowed.

There will be a direction to the respondents to consider the petitioner’s case, in tune with the directions issued by this Court in Ext.P11 judgment.
