IN THE HIGH COURT OF KERALA AT ERNAKULAM
P.M.MANOJ, J
V.K.MOHANAN – Appellant
Versus
NITTA GELATIN INDIA LTD. – Respondent
J U D G M E N T
Dated this the 30th day of January, 2026 The writ petition is preferred challenging Ext.P1 order passed by the District Collector facilitating dredging of the channel for drawing water from the Chalakkudy River to the respondent- Company. The contention of the petitioner is that he had preferred a complaint before the Panchayat stating that the Company was unauthorisedly drawing water from the Chalakkudy River by creating water channels and that, without providing any filtration process, effluent was being discharged into the river, thereby causing havoc in the locality.
On going through the contentions, it appears that the apprehension voiced by the petitioner has already been addressed, as the Company has taken measures to filter the water before it is discharged into the river. As of now, the effluent discharge is being monitored by the Pollution Control Board. Under such circumstances, the grievance raised by the petitioner in this writ petition cannot be sustained.
Accordingly, the writ petition is closed.
