IN THE HIGH COURT OF KERALA AT ERNAKULAM
T.R.RAVI, J
ASSAINAR – Appellant
Versus
SHANAVAS – Respondent

Advocates:
For the Appellants/Petitioners: SRI.JAMSHEED HAFIZ, SMT.T.S.SREEKUTTY, SMT.FATHIMA NASREEN S.

JUDGMENT

The challenge is against an order permitting an amendment of the plaint after the commencement of the trial. The only amendment that was sought was regarding the name of the father of the defendants. Neither the schedule in the suit nor the averments regarding the possession of title are sought to be changed so as to change the nature of the suit. The petitioners also will not be put to any prejudice because of such an amendment. I do not find any reason to interfere with the order of the court below.

The original petition fails and is dismissed.
