The petitioner availed a credit facility from the respondent Bank by mortgaging his land for an amount of Rs.7,50,000/- by pledging 30 cents of property. Due to financial instability, the petitioner could not remit the loan amount and, therefore, the respondent Bank initiated proceedings under the SARFAESI Act by issuing a notice under Section 13(2). The relief sought in this writ petition is to grant 20 equal monthly installments to regularise the loan account and to permit the petitioner to continue paying the monthly installments. 2. The learned counsel for the respondents, on instructions, submits that the Bank is not inclined to grant any installment facility to wipe out the liability. It is submitted that the petitioner is at liberty to approach the Bank under the One-Time Settlement Scheme, now known as the Navakeraleeyam Kudishika Nivarana Scheme.
3. If the petitioner files a representation with a concrete proposal for availing the OTS benefit within three weeks from today, the respondent Bank shall take into consideration the payments already effected, take a final decision on the same, and communicate to the petitioner
