O R D E R

(Dated this the 23rd day of January, 2026)

The petitioner is the sole accused in SC No. 736 of

2023 on the file of the Addl. District and Sessions Court ( Atrocities & Sexual Violence Against women and Children), Kozhikode arising out of Crime No. 94 of 2023 of Beypore Police Station. The offences alleged against the petitioner are under Section 354A , Section s 10 , 9f, 12, 11(i) of the POCSO Act .

2. The prosecution case is that on 15.02.2023, at the class room of Chalium Imbichi Haji Higher Secondary School, Kozhikode the accused who was the English teacher of the victim insulted and outraged the modesty of the victim and made comments with sexual content and thereby he is alleged to have committed the aforesaid offences.

3. The father of the victim filed an affidavit stating that the matter has been settled. The victim who now became major and also the father of the victim had given signed statement to the SHO that the matter has been settled. Though the offences under the provisions of the POCSO Act were also involved, the gravity of the offence alleged against the petitioner is less serious in nature.

In the result, This Crl. M.C is allowed. All further proceedings a
