The petitioner singularly pleads that Ext.P5 application, filed by her under the provisions of Section 379 of the Bharatiya Nagarik Suraksha Sanhita , 2023 ( BNSS ), be directed to be taken up and disposed of within a time frame to be fixed by this Court.

2. Sri.G.Sreekumar (Chelur) – learned Counsel for the petitioner, explained that his client has a definite case that the respondents have committed perjury, by producing false documents and have also indulged in criminal conspiracy and breach of trust; and hence that she has a right to have the application in question decided at the earliest.

3. We cannot find favour with the afore contention of the learned Counsel for the petitioner, for the reason that learned Family Courts are enduring heavy workload, and we cannot be oblivious to this. We have no reason to believe that the learned Family Court will not consider Ext.P5 as per law at the appropriate time. The said application has been filed only in September 2025; and one cannot find any delay in the same being disposed of by the learned Family Court yet.

In the afore circumstances, this Original Petition is dismissed.
