JUDGMENT

When the case is taken up, the counsel for the respondent decree holder submitted that the amount due is less than Rs.60,000/- after crediting the amounts which have been paid pending this Original Petition. The counsel for the petitioner seeks permission to pay off the amounts in instalments.

In the above circumstances, this Original Petition is disposed of, directing the petitioner to pay off the balance amounts in 8 equal monthly instalments, the first instalment becoming due on or before 27.02.2026 and the remaining instalments becoming due on or before the 27th of the succeeding months. If the petitioner commits default in payment of two consecutive instalments, the respondent is at liberty to continue with the execution proceedings. The execution proceedings shall be kept in abeyance to facilitate the payment in instalments.
