The decree for divorce granted at the instance of the petitioner-husband, alleging mental cruelty, is under challenge in this appeal by the wife.
2. The marriage between the parties was solemnised on 18.02.2007. The husband alleges that he is being put to severe mental cruelty on false allegation of illegitimate relationships even with his own mother and the brother’s wife.
3. The respondent-wife denied the allegations.
4. The Family Court found that the materials on record substantiated the making of false allegations as Mat.Appeal No.64 of 2015 claimed by the petitioner-husband and accordingly, granted a decree for divorce.
5. We have heard the learned counsel on either side.
6. The respondent was examined as RW1. In her cross- examination, she has alleged illicit relationship of the petitioner. The Family Court in the impugned judgment held, “It has come out in evidence that, respondent/wife has also raised allegations of illicit relationship of petitioner with his own mother and the wife of his elder brother.” The learned counsel for the appellant could not su
