O R D E R Dated this the 4th day of February, 2026 This Criminal Miscellaneous Case is initiated suo motu by this Court on the basis of a complaint received from the 2nd accused(Unnikrishnan K.V.) in C.C. No.1092/2001 on the file of the Court of the Judicial First Class Magistrate-II, Mananthavady (Trial Court). The 2nd accused had stated in his complaint that, although he was acquitted in the above case, the 1st accused was convicted and sentenced by the said court. Aggrieved by the conviction and sentence, the 1st accused filed Crl.A.No. 95/2009 before the Court of Session, Kalpetta ( Appellate Court). The Appellate Court set aside the conviction and sentence as against the 1st accused and remanded the matter back to the Trial Court. Surprisingly, the Trial Court has again issued summons to the 2nd accused, after the matter was remanded back to the Trial Court. The Portfolio Judge of the said District has directed that suo motu proceedings be initiated. Accordingly, the Crl. M.C was registered.
