The learned Government Pleader for the review petitioners has submitted that Ground C of the review petition would disclose that it is a mistake of the counsel and that the imposition of the costs may be waived.
2. It appears that the costs have been imposed after repeated opportunities were given to file a counter affidavit. The earlier Bench has considered the matter and has given reasons. We do not find an error apparent on the face of the order. Moreover, the said order will ensure that in future such negligent act is not repeated. We find that the costs imposed are not payable to any party, but payable for a good cause. On such consideration, we are not inclined to review the order under challenge. However time to pay costs before the Kerala State Legal Services Authority is extended by one week from today.
3. The review petition is disposed of.
