2026 Supreme(Online)(Ker) 7391

IN THE HIGH COURT OF KERALA AT ERNAKULAM
EASWARAN S., J
ELIAMMA – Appellant
Versus
ANNAMKUTTY – Respondent
RSA NO. 748 OF 2012

Advocates:
For the Appellants/Petitioners:
For the Respondents: SRI.K.S.BHARATHAN

Failure to prosecute an appeal due to relinquished representation leads to dismissal.

Headnote:The appeal has been dismissed due to the appellant's failure to prosecute the case, as no alternate arrangement for representation was made after the relinquishment of vakalath. The court found no intention from the appellant to pursue the matter further. The verdict clearly states the dismissal was for default.

J U D G M E N T

It is submitted by the learned counsel appearing for the appellant that he had already relinquished the vakalath in this appeal. The said fact was already recorded by this Court on 29.11.2025. Till date no alternate arrangement has been made by the appellant.

In such circumstances, it is persuaded that the appellant does not have any intention to prosecute the appeal and hence the appeal is dismissed for default.
