This application is filed underSection 482of theBharatiya Nagarik Suraksha Sanhita, 2023 (for short, BNSS ), seeking pre- arrest bail.
2. The applicants are the accused Nos. 1 and 2 in Crime No.1522/2025 of Kanjirappally Police Station, Kottayam District. The offences alleged are punishable under Sections 318 (4)
and 336(4) of the Bharatiya Nyaya Sanhita , 2023.
3. The prosecution case, in short, is that the applicants who are husband and wife, deceived the defacto complainant by making him believe that they were conducting Fly 2 Schengen, situated at Kairali Lane, North Gate, Vaikom, allegedly engaged in overseas recruitment by publishing advertisements on Facebook and they would procure his visa in foreign countries. They thereby induced the informant to pay a total sum of ₹3,69,950/-, out of which ₹1,00,000/- was transferred via Google Pay into the account of the applicant No.2 and ₹2,50,000/- was obtained in cash by the applicant No.1 at their office at Vaikom in furtherance of their fraudulent and dishonest intention to make wrongful gain by falsely assuring the defacto complainant that they would procure a visa for him to Croatia.
