"Under challenge in this Writ Petition is Ext.P5 Order rejecting permission sought for by the petitioner for conducting display of fire works in connection with the festival of Azhakiyakavu Bhagavati Kshetram, at Paulluruthy. The main objection as stated in page no.3 of the impugned Ext.P5 is that there is a distance of only 50 metres between the place, where the fireworks is scheduled and the State Highway at the eastern side. As regards the grounds for rejection stated at serial nos. 2, 3, 4 and 5, it appears that there is no serious controversy. A perusal of Ext.P3 sketch would indicate that a distance of 100 metres can be maintained by requiring the spectators to remain on the southern side of the structure, which has been marked as 'temple' in Ext.P3. As regards serial no.3, it is pointed out that the hospital is just a clinic, which will not be functioning at 09.00 p.m., when the display is scheduled.Serial no.4 does not have much relevance, inasmuch as permission has not been granted so as to enable the petitioners to store the requisite crackers.
