The mediation agreement between parties is sufficient to quash ongoing criminal proceedings under applicable law.

The petitioners are the accused persons 1 to 3 in Crime No.984 of 2021 of Thadiyittaparamba Police Station, Ernakulam, which is pending as C.C No.35 of 2022 on the file of Judicial First Class Magistrate Court, Kakkanad. They filed this petition under Section 528 of BNSS praying for quashing all further proceedings against them. The offences alleged against the petitioners are under Sections 294 (b) and 506 of IPC and Section

119(a) of Kerala Police Act .

2. When this matter was pending before this Court, the case was referred for mediation to the Mediation Centre attached to this Court. As per the memorandum of settlement dated 21.01.2026, both sides agreed to quash all further proceedings against the petitioners. They also decided to quash the counter case pending against the de facto complainant herein.

In the above circumstance, this Crl.M.C is allowed. All further proceedings against the petitioners in C.C No.35 of 2022 on the file of Judicial First Class Magistrate Court, Kakkanad, arising from Crime No.984 of 2021 of Thadiyittaparamba Police Station, Ernakulam, stands quashed under Section 528 of B.N.S.S.
