JUDGMENT

This writ petition is filed with following prayers:

i. Issue a writ of mandamus or any other writ order or direction commanding the respondents 3 to 6 to grant permission to petitioner to conduct elephant procession/parade in the ensuing “Sivaratri” festival as requested in Ext.P4 to P6 expeditiously;

ii. To declare that the respondents 2 to 5 are duty bound to grant permission to petitioner to conduct the elephant procession in connection with the ensuing festival, as the petitioner had already applied for registration as is evident from Ext.P3;

iii. To declare that the respondents 3 to 5 cannot decline the request of the petitioners to register the petitioner with the 4th respondent as there is no direction in Ext.P1 order that after the prescribed period the registration should not be done;

iv. Issue a writ of mandamus or any other writ, order or direction, directing the respondents 2 and 6 to register the temple of the petitioner under Kerala Captive Elephants (Management and Maintenance) Rules , 2012 and grant permission to conduct elephant procession as requested for in Ext.P4 and Ext.P5 for the Shivarathri festival scheduled from 24-02-2025 to 26-02-2025;

v. to issue such other writ, order or direction as this Hon’ble Court may deem fit and proper in the circumstances of the case.

vi. to permit the petitioner to produce translations of the vernacular documents as and when directed by this Hon’ble Court;

2. The prayer in this writ petition is to grant permission for an elephant procession in connection with the Sivaratri festival of the year 2025. The prayer in this writ petition are infructuous. The counsel for the petitioner submitted that Sivaratri is approaching in the current year. The petitioner is free to file a fresh writ petition with appropriate prayer.

This writ petition is closed.
