JUDGMENT

The prayer in the original petition is for an early disposal of O.S.No.1233 of 2017 pending before the II Additional Munsiff Court, Ernakulam within an outer time limit before 28.02.2026. It is submitted that directions have already been issued by this Court in OP(C) No.1296/2023 and OP(C) No.1315/2024 to dispose of the case but the case is still pending. This Court had called for a report from the Judicial Officer. The Judicial Officer has reported that several interlocutory petitions were filed and on 05.02.2026 the court had allowed I.A.No.1/2026 partly directing the 1st defendant to produce Ext.P7 in W.P.(C) No.2285/2013 filed by the 1st defendant within 7 days. It is also stated that I.A.No.50/2025 filed to accept additional witness list has been dismissed. The court has further stated that currently there are no interlocutory applications pending and the evidence can hence be closed and the case can be posted for final hearing after the 1st defendant produces the documents as directed.

In the above circumstances, the original petition is disposed of, recording the report of the Judicial Officer and directing that the suit shall be disposed of as expeditiously as possible, at any rate, within two months from the date of receipt of a certified copy of this judgment.
