The necessity for timely consideration of representations to alleviate grievances regarding unauthorized obstructions.

JUDGMENT

This writ petition is filed seeking the following reliefs:

“i) Issue a writ of mandamus or any other appropriate writs, orders or directions commanding the 2^nd respondent to consider Exhibit P7 and pass orders on the same, forthwith, without any further delay;

ii) Issue a writ of mandamus or any other appropriate writs, orders or directions commanding the respondents 1, 2 and 5 to remove the illegal obstruction caused to the common road leading to the properties of the petitioner by removing the gate put up by the respondents 3 and 4 forthwith;

iii) Dispense with the filing of English translation of Vernacular documents;

iv) Grant such other reliefs as this Hon’ble Court may deem fit and proper in the circumstances of the case.

2. The petitioners submitted Ext.P7 representation to include a road in the asset register and to remove an unauthorised gate. The grievance of the petitioners is that the 2^nd respondent is not considering the same.

3. Heard the learned counsel for the petitioners and the learned Standing Counsel appearing for respondents 1 and 2. I have also heard the learned Government Pleader. The manner in which this writ petition is going to be disposed of, notice is not necessary to respondents 3 and 4. If they are aggrieved by any of the directions issued by this Court, they are free to file a review petition before this Court.

4. Considering the limited prayer of the petitioners for consideration of Ext.P7 by the 2^nd respondent, I am of the view that their prayer can be allowed.

Therefore, this Writ Petition is disposed of with the following directions:

1. The 2^nd respondent is directed to consider Ext.P7 appeal after giving sufficient opportunity of hearing to the petitioners and respondents 3 and 4, as expeditiously as possible, within a period of two months from the date of receipt of a copy of this judgment.

2. The petitioners will produce a certified copy of this judgment, along with a copy of this Writ Petition with exhibits, before the 2^nd respondent for compliance.
