JUDGMENT

This writ petition is filed seeking the following reliefs:

“i) Issue a writ of mandamus or any other appropriate writs, orders or directions commanding the 2nd respondent to consider Exhibit P7 and pass orders on the same, forthwith, without any further delay;

ii) Issue a writ of mandamus or any other appropriate writs, orders or directions commanding the respondents 1, 2 and 5 to remove the illegal obstruction caused to the common road leading to the properties of the petitioner by removing the gate put up by the respondents 3 and 4 forthwith;

iii) Dispense with the filing of English translation of Vernacular documents;

iv) Grant such other reliefs as this Hon’ble Court may deem fit and proper in the circumstances of the case.

2. The petitioners submitted Ext.P7 representation to include a road in the asset register and to remove an unauthorised gate. The grievance of the petitioners is that the 2nd respondent is not considering the same.

3. Heard the learned counsel for the petitioners and the learned Standing Counsel appearing for respondents 1 and 2. I have also heard the learned Government Pleader. The manner in which this writ petition is going to be disposed of, notice is not necessary to respondents 3 and 4. If they are aggrieved by any of the directions issued by this Court, they are free to file a review petition before this Court.

4. Considering the limited prayer of the petitioners for consideration of Ext.P7 by the 2nd respondent, I am of the view that their prayer can be allowed.

Therefore, this Writ Petition is disposed of with the following directions:

1. The 2nd respondent is directed to consider Ext.P7 appeal after giving sufficient opportunity of hearing to the petitioners and respondents 3 and 4, as expeditiously as possible, within a period of two months from the date of receipt of a copy of this judgment.

2. The petitioners will produce a certified copy of this judgment, along with a copy of this Writ Petition with exhibits, before the 2nd respondent for compliance.
