IN THE HIGH COURT OF KERALA AT ERNAKULAM
N.NAGARESH, J
LEENA V.A – Appellant
Versus
THE STATE OF KERALA – Respondent
WP(C) NO. 3063 OF 2026
For the Appellants/Petitioners: SRI.V.A.MUHAMMED, SRI.M.SAJJAD
For the Respondents: SMT. V.A. HARITHA, GOVERNMENT PLEADER
The court emphasized the necessity for timely administrative action following established precedents in education employment matters.
Headnote:In this case, the petitioner sought relief regarding the regularization of pay after prior spells of approval were granted by the Educational Officer based on an earlier judgment (W.P.
(C) No.2454/2021). The Court directed the 2nd respondent to consider the petitioner's submission (Ext.P3) and issue a decision within two months. Key issues included the legal basis for pay regulation and the procedural adherence.
Result: The petition was disposed of with clear instructions to the DEO to act upon the submission timely.

JUDGMENT
Dated this the 3rd day of February, 2026 The petitioner states that her earlier spells of approval for appointment to the post of HST (Hindi) from 02.06.2008 to 31.05.2011 is granted by the Educational Officer following the judgment in W.P.(C) No.2454/2021. However, the respondents have failed to revise and regularise the pay consequent to the same. The reason extended is that the regularisation of pay can be granted only after getting further instructions from the Government.
2. Be that as it may, I find that the petitioner has already approached the 2nd respondent-DEO in this regard by filing Ext.P3. In the facts of the case, it would be only just and proper that the 2nd respondent considers Ext.P3 and passes appropriate orders thereon, within a reasonable time.
The writ petition is accordingly disposed of directing the
2nd respondent to consider Ext.P3 and take appropriate decision thereon in accordance with law, within a period of two months.
