This application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, BNSS ), seeking regular bail.
2. The applicant is the sole accused in Crime No.1490/2025 of Kunnathunadu Police Station, Ernakulam District. The offences alleged are punishable under Sections 63 (a), 63(b), 63(d)(iv), 64(1), 64(2)(m), 65(1) and 71 of the Bharatiya Nyaya Sanhita, 2023 and Sections 4 read with 3(a), 3(b), 6 read with Section 5 (i), 5(l) and 8 read with Section 7 of the POCSO Act, 2012 .

The prosecution case, in short, is that the applicant, who is the neighbour of the victim girl aged only 15 years got acquainted with her, and on 21/08/2025 at 04:00 p.m., he went to the rented house of the victim and caused her to sit on his lap, kissed her and on 02.10.2025 at 10:00 a.m., he again went to the house of the victim and hugged her belly, removed her dresses and inserted his penis into her anus, thereby committed an unnatural sexual assault against the victim.
