This application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, BNSS ), seeking regular bail.
2. The applicant is the sole accused in Crime & Occurrence Report No.170/2025 of Excise Range Office, Muvattupuzha, Ernakulam District. The offence alleged is punishable under Section 22 (b) of theNDPS Act.
3. The prosecution case, in short, is that when the Excise party was doing patrolling in their vehicle, in front of the shop called Ceramic Centre, 5 meters east of the electric post number M2/MK/55 located on the south side of the Kothamangalam - Muvattupuzha road at Keecheripady Junction, Kavunkara, Vellurkunnam Village, Muvattupuzha Taluk, the applicant suddenly droped a plastic cover from his left hand, the Excise party picked up the same and checked it. A crystal shaped substance weighing 2.799 grams was found in the said plastic cover by the Excise party and the same was tested with the help of a drug detection kit and it was found to be MDMA. Thus, the applicant has committed the aforesaid offence.
