Headnote:The Writ Petition challenges Ext.P15, which denied the exclusion of the petitioner's land from an environmentally sensitive area as per the Forest Act. The petitioner seeks to close the matter, reserving rights to approach the Forest Tribunal under Section 10 of the Kerala Forest Act, 2003. The Court grants the requested liberty and concludes the Writ Petition.
JUDGMENT
Ext.P15 is under challenge in this Writ Petition, which refused petitioner's application for exclusion of her land from the purview of the notification declaring ecologically fragile land. When this matter is taken up for consideration today, learned counsel for the petitioner would submit that the Writ Petition may be closed, reserving the liberty of the petitioner to approach the Forest Tribunal as per Section 10 of the Kerala Forest (Vesting and Management of Ecologically Fragile Lands) Act, 2003 .
Liberty sought for is granted and the Writ Petition will stand closed accordingly.
