JUDGMENT

Dated this the 12^th day of February, 2026 The petitioner, who is working as a Driver on daily wage basis under the 3^rd respondent-Municipality, has approached this Court seeking the following reliefs:

“i) To issue a writ of mandamus or any other appropriate writ, order or direction to respondents no.3 to 5 to consider petitioner for the selection process to the appointment as sanitation workers in contingent service of 3^rd respondent Municipality along with candidates sponsored by Employment Exchange pursuant to Ext.P2.

ii) To issue a writ of certiorari or any other appropriate writ or order or direction to quash Exts.P5 and P6 Government orders to the extent of limiting selection and appointment of cleaning/sanitation workers in contingent service of Municipality to candidates sponsored by Employment Exchange alone in view of dictum laid down in Excise Superintendent v. K.B.N Visweswara Rao (1996) 6 SSC 216 and Union of India & Ors. v. Pritilatha Nanda, 2010 KHC 4489 .

iii) To issue a writ of mandamus or any other appropriate writ, order or direction to respondents no.3 to 5 to consider Ext.P3 representation of petitioner within a time frame fixed by this Hon’ble Court.”
