JUDGMENT
Dated this the 12th day of February, 2026 The petitioner, who is working as a Driver on daily wage basis under the 3rd respondent-Municipality, has approached this Court seeking the following reliefs:
“i) To issue a writ of mandamus or any other appropriate writ, order or direction to respondents no.3 to 5 to consider petitioner for the selection process to the appointment as sanitation workers in contingent service of 3rd respondent Municipality along with candidates sponsored by Employment Exchange pursuant to Ext.P2.
ii) To issue a writ of certiorari or any other appropriate writ or order or direction to quash Exts.P5 and P6 Government orders to the extent of limiting selection and appointment of cleaning/sanitation workers in contingent service of Municipality to candidates sponsored by Employment Exchange alone in view of dictum laid down in Excise Superintendent v. K.B.N Visweswara Rao (1996) 6 SSC 216 and Union of India & Ors. v. Pritilatha Nanda, 2010 KHC 4489 .
iii) To issue a writ of mandamus or any other appropriate writ, order or direction to respondents no.3 to 5 to consider Ext.P3 representation of petitioner within a time frame fixed by this Hon’ble Court.”
