ORDER
Dated this the 12th day of February, 2026 The sole accused in C.C.No.484/2024 on the file of the Judicial First Class Magistrate, Kolencherry, arising out of Crime No.366/2023 of Kunnathunadu police station, filed this Crl.M.C. under Section 528 of BNSS, praying for quashing all further proceedings against him. The offences alleged against the petitioners are under Sections 354 , 354A(1)(i) of IPC .
2. The prosecution case is that the accused with the intention to outrage the modesty of the defacto complainant on 17.05.2023 at about 4.35 p.m., at the premises of Wonderla Holidays Ltd., grabbed the buttocks of the defacto complainant and thereby outraged her modesty.
3. When this matter was taken up for hearing on admission, the learned counsel for the petitioner sought for permission to withdraw this Crl.M.C. with liberty to raise all contentions before the trial court. Permission granted. This Crl.M.C. is dismissed as withdrawn with liberty to the petitioner to raise all contentions before the trial court.
