The parties have settled their disputes in mediation. Though the 3rd respondent who is required to contest the suit, is not a party to the compromise, in the light of the statements contained in paragraph 3 of the memorandum of settlement, the signature is dispensed with.

The memorandum of settlement is accepted and the appeal is disposed of in terms of the settlement. The memorandum of agreement will form part of this judgment.
