Contempt proceedings are not warranted when the related writ petition is pending and appropriate applications can be filed within it.

Headnote:This contempt case alleges violation of the interim order dated 04.12.2025 in WP

(C) No.42979/2025. The court finds that a separate contempt case is not warranted as the writ petition is still pending before the same bench. The petitioner is granted liberty to file appropriate application in the pending writ petition. Consequently, the contempt case is closed.

JUDGMENT

This contempt case is filed alleging violation of the interim order dated 04.12.2025 in WP(C) No.42979/2025. Admittedly, the writ petition is pending and is to be heard by the same Bench. In such circumstances, a separate contempt case need not be entertained. The petitioner can file appropriate application in the pending writ petition if there is any violation of the interim order.

Granting liberty to the petitioner to file appropriate application in the pending writ petitioner, this contempt case is closed. All the contentions raised by the petitioner in this contempt case are left open.
