JUDGMENT
The petitioners have approached this Court seeking to challenge Exts.P5 and P7 orders issued under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. This Court, on 11.04.2023, taking note of the contentions raised, issued the following order:-
“Sri.M.Sasindran, the learned counsel appearing for the petitioners, submitted that the order passed by the Appellate Tribunal cannot be sustained under law. According to the learned counsel, the mother of the 1st petitioner did not claim the relief that was granted by the Appellate Tribunal. It is further submitted that the petitioners cannot be forced to accommodate their mother in their house.
I find that the 1st respondent is aged 86 years, and she is the mother of 9 children. The District Collector has only directed the petitioners to accommodate the mother in their residential home and to ensure that no physical or mental harm is caused. There was also a direction for the petitioners to take care of the mother without causing her any inconvenience.
Having regard to the facts, I am not inclined to stay the operation of the order as prayed for by the petitioners.”
