JUDGMENT
This appeal is filed by the claimant in O.P (MV) No.71 of 2009 on the file of the Motor Accidents Claims Tribunal, Alappuzha, claiming enhancement of compensation. The respondents herein were the respondents 2 and 3 before the tribunal.
2. According to the claimant, on 25.12.2006 at about 07.45 am, while the claimant was travelling as a pillion rider in a motorcycle bearing reg. No. KL-04/S-6205, an autorickshaw bearing registration No.KL-06/B-4967 driven by the 1st respondent in a rash and negligent manner hit on the motorcycle. As a result of the accident, he had sustained serious injuries. The claimant approached the tribunal claiming compensation of ₹2,50,000/-. 3. The first, second and third respondents were the driver, owner and the insurer of the offending vehicle. The 1st respondent filed a written statement contending that the petition is not maintainable as well as the quantum of compensation claimed is excessive. The 3rd respondent filed a written statement admitting the policy but disputing the quantum of compensation claimed as well as the validity of driving licence and vehicular documents.
