JUDGMENT
This appeal is filed by the claimant in O.P (MV) No.560 of 2013 on the file of the Motor Accidents Claims Tribunal, Tirur, claiming enhancement of compensation. The respondents herein were the respondents before the tribunal.
2. According to the claimant, on 12.02.2013 at about 09.00 am, while the claimant was riding a motorcycle bearing reg. No. KL-65- A-9096, a lorry bearing registration No.KL-01-TC-23-2009 driven by the 2nd respondent in a rash and negligent manner hit against the motorcycle. As a result of the accident, he had sustained serious injuries. The claimant approached the tribunal claiming compensation of ₹10,50,000/-
3.The first respondent/owner and the second respondent/driver of the offending vehicle remained absent and was set ex parte before the tribunal. The 3rd respondent/insurer filed a written statement admitting the policy but disputing the quantum of compensation claimed. Before the tribunal Exts.A1 to A27 and Ext.C1 and C2 were marked. The tribunal, after analysing the pleadings and materials on record, awarded a sum of ₹6,58,036/-
rounded to 6,58,040/- with interest at 9% per annum as compensation under various heads against the 3rd respondent/insu
