Dated this the 17th day of February, 2026 Ext.P8 is under challenge, which refused a permission sought for by the petitioner to conduct display of fireworks in connection with the festival of 'Vazhalikkavu Bhagavathy Kshethram'. The first reason stated in Ext.P8 is with respect to the absence of a permanent magazine, which requirement has been dispensed with by this Court on several occasions and in various judgments pointing out that a permanent magazine, as such, is not required for a temporary event, like the display of fireworks on specified days in connection with the festival of a temple and that a portable magazine would suffice. In the circumstances, the first objection cannot stand, and the same will stand rejected.
2. Coming to the second objection, it is the submission made by the learned counsel for the petitioner that there is no accredited Agency to issue the Risk Assessment Report and the On-site Emergency Plan, the nearest one being available is only at Nagpur.
