JUDGMENT It is pointed out by the learned counsel for the respondent that the award was passed on 15.03.2012 for an amount of Rs.2,98,450/- along with 12% interest against the petitioner. The said award is not under challenge. However, the petitioner has an alternate remedy under Section 69 of the Kerala Co-operative Societies Act and therefore, this petition would not be maintainable. On perusal of the records, it is seen that this award is not under challenge and only the recovery proceedings is under challenge. Therefore, this writ petition is not maintainable. However, at this stage, the learned counsel for the petitioner seeks leave of this Court to withdraw the writ petition with liberty to avail appropriate remedy, in accordance with the law.

With the aforesaid liberty, this writ petition is dismissed as withdrawn.
