IN THE HIGH COURT OF KERALA AT ERNAKULAM
MOHAMMED NIAS C.P., J
NUSAIBA BEEVI – Appellant
Versus
THE DISTRICT COLLECTOR – Respondent
JUDGMENT
The petitioner challenges Exts.P4 and P5 notices issued by the revenue recovery authorities to execute the award in O.P(MV) No.484 of 2016 on the files of the Motor Accident Claims Tribunal, Kollam, which was passed against the petitioner's son. The petitioner complains that the revenue recovery action is proceeding against the petitioner's self-acquired property, which cannot be done in execution of the award mentioned above. Challenging the revenue recovery action, the petitioner has preferred Ext.P6 application before the District Collector.
2. Taking note of the above, there will be a direction to the said respondent to pass orders on the same, if not already done, within two months from the date of receipt of a copy of this judgment. The District Collector shall also hear the additional third respondent, who is stated to be the claimant in the original petition, while passing orders, as directed above. It will be open to the parties to produce such materials to substantiate their contention, which shall be adverted to by the first respondent while taking a decision, as directed above.
The writ petition is disposed of as above.
